Number of seats A hackney carriage and/or private hire vehicle is a motor vehicle constructed or adapted to seat fewer than nine passengers. Spaces in vehicles, which have been constructed or adapted to carry wheelchairs, shall be counted in the total seating capacity. Proprietors should be aware that converting a vehicle could affect its taxation class and must ensure that this is amended. |

Leaving your vehicle unattended on a Rank It has come to our attention that some drivers are leaving their vehicles unattended for a period of time. Please remember that this is extremely frustrating for other drivers and it could also be seen as obstructing other drivers from their business. Enforcement Officers will be monitoring the situation and may consider taking enforcement action against those that abuse the legislation. Moving up the Rank Advice has been given on more than one occasion to hackney carriage drivers regarding moving up the rank but some still appear to be disregarding this and it is causing some disquiet amongst the Trade. Byelaw 7 (d) states: "The driver of a hackney carriage shall, when plying for hire in any street and not actually hired from time to time when any other carriage immediately in front is driven off or moved forward cause his carriage to be moved forward so as to fill the place previously occupied by the carriage driven off or moved forward". I would like to advise you therefore that this breach of byelaw will no longer be tolerated and enforcement action will be taken against any offenders. Spouses Spouses are not allowed to drive any licensed hackney carriage vehicle or private hire vehicle (even if it is for social and domestic purposes only) unless they hold the appropiate licence, doing so will result in prosecution. On occasions insurance companies have included spouses on policies but this does not override the above legislation. |

Private Hire Private hire vehicles can only be driven by licensed private hire drivers. Restricted private hire driver's CAN drive any licensed private hire vehicle but ONLY for the purpose for which they are licensed. Drivers with the condition 'Home to School Transport Contract Work Only' on their licence can drive a red private hire vehicle but only for school runs. Private hire drivers CANNOT drive a licensed hackney carriage vehicle without having a hackney carriage driver licence. Any further advice on this issue please contact a member of the licensing team. Please note the legislation and case law that endorses these requirments. ( It is interesting to note that a garage mechanic CANNOT drive a private hire vehicle for test purposes on the public highway, unless he holds a private hire driver licence himself. It is otherwise illegal. Ed.) |
